Texas DWI/DUI Defense Attorney
DWI/DUI charges in Texas are most often misdemeanor cases, but are felonies after the second conviction. Aggravated DWI/DUI charges are the result of injuries or fatalities involving drunk driving. If you have been charged with a DWI in Houston or the surrounding area, contact DWI defense lawyer Anthony W. Hernandez in Houston to schedule a consultation.
The Traffic Stop
One of the first questions to ask after a drunk driving arrest is whether there was sufficient probable cause for the police to have stopped you in the first place. An examination of the police report will give the official version of the observations of the law enforcement officer that led to your traffic stop and arrest: Did the police officer report credible indications of intoxication, such as slurred speech, failed field sobriety tests, or high numbers on a Breathalyzer test?
Field Sobriety Tests ◦ Breath Test
A second avenue of defense may focus on the field sobriety tests and the Breathalyzer test. Was the Breathalyzer properly calibrated? Was the police officer properly trained in its use? Did he or she explain your legal rights at every step in the process of the traffic stop, the field sobriety testing and the arrest?
Conditions of Lesser Charges or Sentence
Even if your DWI charges are supported by compelling evidence, there may be opportunities to agree to conditions such as participation in alcohol abuse treatment or use of an interlock device on your vehicle in exchange for lesser charges or less severe penalties.
Without the advocacy of a vigorous, experienced DWI criminal defense lawyer, your driver's license may be revoked or your driving may be restricted to that allowed with an occupational driver's license.
DWI criminal defense attorney Anthony W. Hernandez has over 20 years of experience, and he will use his extensive experience to defend clients charged with state and federal crimes, including driving under the influence of alcohol or drugs.
